Timing is everything when it comes to January’s divorce month title

A Cheshire-based family law solicitor believes that January being dubbed ‘divorce month’ is primarily down to the strains of domestic life.

Danny Hudson, partner and a member of the family department at Watsons Solicitors, says his team sees an increase in couples filing for separation at the start of each year.

However, he’s acutely aware that there are several extenuating circumstances that help create a spike in those divorce proceedings.

For example, couples often park any talk of splitting in the months leading up to Christmas for the sake of any children, although the pressures of the festive period take their toll.

There are also emotional and financial burdens, as well as families being forced to spend more time together, which can expose issues.

The phrase ‘new year, new me’ is heavily used when January rolls around each year, with some resolutions stretching as far as a fresh start that can ultimately mean divorce.

Danny said: “For some, Christmas and everything the festive season brings in terms of expectations, is not always a joyous occasion.

“Rather than seeing it as a perfect opportunity to unwind by spending time with family and friends, some people worry, as it can confirm what they perhaps feared about their relationship.

“We often see spikes in divorce at the start of the year and after the summer holidays. Those are two times when people are forced to be together, and some couples can’t cope.”

Separation was made less confrontational in April 2022 with the introduction of no-fault divorce, legislation that allows couples to part ways without assigning blame.

Danny continued: “The law change has made it much more straightforward for separation to occur.

“There’s no requirement to cite unreasonable behaviour or adultery, which eases the burden on one, if not both, parties.

“Making it easier does not mean it’s always the right thing to do, however, so we always advise our clients to take their time over any decision, and divorce is absolutely no different.”
