Cheshire law firm explores why marriage length before divorce is at an all-time high

October 23, 2026

A leading Cheshire law firm solicitor suggests that the cost of living, the length of time taken to finalise, and the positive impact of mediation are key factors behind record-breaking divorce statistics.

Data published by the Office for National Statistics (ONS) reveals that the average duration of marriage at divorce for opposite-sex couples has reached 13 years, the longest since records began in 1963.

The introduction of the Divorce, Dissolution and Separation Act 2020, which came into effect in 2022, has made the process seemingly easier than ever with people able to end their marriage without having to assign blame.

However, separation can still bring a range of personal and financial challenges, with several factors influencing the difficulties both parties may face throughout the process.

These include:

  • The cost of living: It is becoming increasingly difficult for individuals to afford living alone, forcing many couples to remain together as a result.
  • The length of the process: Divorce typically takes at least six to seven months but often longer.
  • Mediation: More than 70 per cent of cases are resolved on the day, helping families reach agreements without going to court.

Danny Hudson, partner and member of the family department at Watsons Solicitors, believes that while longer-lasting marriages before divorce may appear positive, it can also highlight the complexities surrounding people going their separate ways.

He said: “Couples spend years building a life together, whether that involves buying properties, amassing savings, or raising children.

“When relationships break down, separating these shared assets and making arrangements based on what’s best for the family can be complicated.

“The uncertainty surrounding the process makes it difficult for both parties to know how to move forward.

“As a result, some may choose to remain in their situation and continue with their existing circumstances rather than face the challenges brought on by divorce.

“However, understanding the options available, including the costs, timescales, and the role of mediation can help couples make informed decisions about their future and identify the most appropriate way forward.”

Additional ONS findings show that 105,961 legal partnership dissolutions were recorded in England and Wales in 2025, which is in line with the previous two years and significantly below the peak levels seen between the 1980s and 2000s.
