Seeking legal advice is the smart choice when it comes to writing a will

A leading Cheshire-based private client solicitor is urging people to seek legal advice when writing a will, with three in four people likely to experience a dispute in their lifetime.

Whilst creating one with the help of a professional remains the most popular course of action, there has been a rise in DIY documents, sparked by the pandemic.

Kristel Clarke, a member of the probate department at Warrington-based Watsons Solicitors, wants people to be aware of the potential pitfalls of relying solely on online forms.

Kristel, who is appointed by the Court of Protection as a Deputy in relation to property and financial affairs, said: “Piecing a will together requires careful wording and understanding to ensure that everyone’s wishes are accurately recorded.

“The signing appears straightforward, but failure to meet the legal requirements can render the document invalid or require extra work by your loved ones.”

The guidance of a solicitor also means the right questions are asked in terms of property and your estate, while topics such as asset protection, inheritance tax, and powers of attorney will also be discussed.

Kristel continued: “The writing of a will is only one part of planning; a solicitor will be able to talk an individual through the many other practical and legal matters.

“A specialist in the field can also help protect assets from subjects including care fees and divorce.”

Indeed, not every modern family fits nicely into the ‘married with two children’ demographic, and consideration for complex home structures must be given.

Kristel added: “Accounting for step children can be complicated, and failing to follow the correct procedures can leave those closest to you with nothing, which can prompt time-consuming and expensive claims.”
