Experiencing a dispute with a person or a business can be a difficult and upsetting time. However, there is no need to suffer in silence or just put up with it if you feel that you have been wronged. Read on to find out how we can help you to settle a dispute.

What is a dispute?

A dispute is a varied term that is used to describe a disagreement or conflict between two parties. It usually involves financial matters and can be related but not limited to:

  • Contracts for the supply of goods or services
  • Intellectual property
  • Unfair market practices
  • Trade practices
  • Commercial tenancy disputes

How can we help?

How we can help with a dispute is really down to how you would like to move forward legally. For first time disputes, we will mostly recommend legal mediation or other alternatives to court action. Mediation is the attempt to settle a dispute between two or more parties without going to court. It is usually the most productive way to settle disputes as it enables all the parties involved to listen to what the others have to say, and to be able to get their point across in a polite, professional environment – this is quite often all that is needed for everyone to leave the dispute happy and able to look to the future. Once all parties have reached an agreement, documents will be signed – these will legally bind the outcome.

Another alternative to taking the dispute to court is to go through a conciliation process. This method involves a conciliator seeing all of the parties separately and then together at the same time to try and resolve the differences. At some point during the conciliation, the parties will ask the conciliator to create a non-binding settlement proposal.

Not only are alternative dispute resolutions methods are the most cost effective and time efficient ways to resolve a dispute, but they are also much less stressful than taking the dispute to court. However, this does not mean that taking your dispute to court is out of the question entirely. If the alternative routes fail, then litigation is the effective last resort.
