Am I entitled to make a personal injury claim?

June 29, 2016

Every year, millions of people are injured. These injuries can occur at home, in the workplace, in public spaces or on the roads.

A personal injury is, in the eyes of the law, a physical or psychological injury that has occurred as a result of negligence or an accident.

However, to be entitled to a personal injury claim, you need to be able to prove that your injury has caused significant physical or psychological damage. So if you trip over a paving stone and lightly graze your knee, you probably won’t get any compensation.

If a person slips on some spilt water in a shop and breaks their wrist, and there wasn’t a wet floor sign, the shop would be liable for the person’s injury.

What are the effects of a personal injury?

These can have differing effects on the claimant, depending on the type of personal injury.

It’s not just the physical aspect of being injured that causes harm, there are also psychological effects that a personal injury can cause.

For example, if a pedestrian is involved in a car accident and their leg is broken, the leg might heal completely after a couple of months. However, that individual might develop anxiety issues, stemming from the accident.

These anxiety issues could affect their ability to do their job, their relationships and their general quality of life.

Gaining compensation for a personal injury is not just about funding medical bills; it’s also about providing financial security for the claimant’s future.

How much is a personal injury claims settlement?

The amount of money the claimant receives in a personal injury claims settlement can vary.

For example, if a person sprains their ankle, they will most likely receive much less compensation than someone whose leg has to be amputated following a motorbike accident.

Things to remember if you’re considering making a personal injury claim

Thinking of making a personal injury claim? There are a variety of things you need to remember. Some of the most important factors to consider are:

• Personal injury compensation advertisements regularly feature on TV. However, it’s important to always go through a trusted solicitors firm, and remember – if it sounds too good to be true, it probably is.
• Has it been less than three years since the accident? In the UK, claimants have three years to make a claim, from the day of the accident.
• Do you have proof of your injury? There are many ways you can prove your injury, including your medical records.
• Record everything to do with the injury. This could include times, dates and any witnesses involved.
